11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOFTOSIST PVT. LTD., ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Softosist reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

 

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India. You consent to personal jurisdiction in such courts and waive any objection to venue.

 

15. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our Services, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may initiate formal legal proceedings in accordance with the governing law clause above.

 

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity or enforceability of the remaining provisions.

 

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by Softosist, constitute the entire agreement between you and Softosist with respect to your use of the Services and supersede all prior agreements and understandings.
